Owner’s Policies
An Owner's Policy insures a purchaser of real property that the title to the property is vested in that purchaser and that the property is free from all defects, liens and encumbrances except those listed as exceptions in the policy or are excluded from the scope of the policy's coverage. The liability limit of the owner's policy is typically the purchase price paid for the property.
Lender’s Policies
A Lender's Policy insures a lender/mortgagee against loss caused by invalidity or unenforceability of the mortgage lien, which might occur as a result of defective title, or against loss of priority of the mortgage and that the property is free from all defects, liens and encumbrances except those listed as exceptions in the policy or are excluded from the scope of the policy's coverage.
Leasehold Policies
A leasehold policy insures either the owner of a leasehold estate or a lender making a loan secured by a mortgage on the leasehold estate with respect to the title of the property.
Tenants who sign leases of significant duration and make expensive leasehold improvements often seek the protections offered by a leasehold policy.
With a leasehold policy in place, if a tenant is prevented from using a property because of an insured title matter, the tenant will be covered under this title insurance policy.
Co-Op Policies
A co-op policy insures the ownership of the debtor's cooperative interest in a cooperative organization.
Title Searches
A full coverage title search includes searches related to liens, mortgages, taxes, easements, covenants, conditions and restrictions (CC&Rs), agreements, and ordinances that will affect the subject property.
Essentially a title search seeks to answer the following questions:
- Does the seller have a saleable interest in the property?
- What kind of restrictions or allowances pertain to the use of the land?
- Do any liens exist on the property which need to be paid off at closing?
Document Preparation
Document Preparation is the process of arranging and preparing the closing contracts and documents. These documents vary by industry and state but generally contain a deed, note, mortgage, disclosures, settlement statement, and other documents describing and detailing the agreement between the buyer, seller, borrower, and lender. The title company may also arrange and receive documents from other parties and will coordinate the execution and distribution of these documents.
Title and Document Review
A title and document review involves reviewing the title commitment to examine and understand the items included and excluded from coverage, and reviewing the accuracy of the basic information in the commitment to help avoid future issues. Should any of the exceptions listed on the commitment be of concern, the buyer may have the opportunity to notify the sellers of the item they find unacceptable and based on their contractual obligations require that the sellers remedy it prior to closing. Alternatively, if a problem cannot be remedied, the buyer may have a right to terminate the purchase contract altogether. A lender may also require certain information to be provided to them based on their review of the title commitment.
A document review may also involve reviewing the loan documents to determine proper execution and acknowledgment, and ensure compliance with all interested parties’ closing instructions, as well as any state specific recording requirements.
Closing and Escrow Services
Closing and escrow services involve executing the specific instructions of the buyer, seller, and lender outlined within the purchase agreement and loan closing package. The services may include loan document review, ID validation, preparation and provision of the settlement statement, title curative services, notary and/or attorney signings, payoffs and disbursement of funds, proration of insurance and taxes, and the transfer of title after all the conditions necessary to the transaction are complete.
Recording Services
Recording services involve physically and/or electronically delivering the deed and other property related documents to the recorder’s office for filing in the record books in the county or locale where the property is located. Each State and each locale may have their own specific requirements as to how a document must be presented and as to the costs associated with recording or filing of specific documents. In addition, there may be recording taxes that must be submitted together with the documents. The recorder's office keeps a set of indexes containing information about each document so that the document can be discovered by a future title search.

Lender's may also require specific pre-closing filings or recordings as well as additional searches to further research the borrowers. These may include ordering Multi-Jurisdictional Lien Searches, Litigation Searches, Entity Formation and Qualifications, Municipality Zoning and Compliance Letter Procurement as well as National Recordings and Filing Services
